Earlier this week Nick Diaz’s lawyer Ross Goodman filed a lawsuit against the Nevada State Athletic Commission in response to a temporary suspension Diaz was given following his UFC 143 bout against Carlos Condit, Nick’s camp felt that the temporary suspension was unlawful and are unhappy with the delays and time it has taken for the NSAC to set a date for Diaz’s full hearing with the commission.
The lawsuit was filed for alleged violations of statutory law and his constitutional rights to due process. The lawsuit was filed on Tuesday, April 24th and was first reported by MMAFighting.com.
The temporary suspension came as a result of Nick failing a post-fight drug test which followed the Condit bout, he tested positive for marijuana metabolites which were found in his system as a result of the test.
With the combination of delays to the hearing, Ross Goodman is now asking for a full dismissal of the charges. As well as this Goodman also called on a Nevada legislative statute that says the commission would need to rule on the Diaz case within 45 days of the temporary suspension or Diaz and his team would consider the NSAC’s complaint null and void.
The retired welterweight UFC fighter has not made it clear if or when we may ever see him back in the octagon but it is clear that he and his team are not happy with the NSAC’s punishment.
